These Terms & Conditions (the “Terms”) govern your access to and use of https://seabmusic.com/, including its store, accounts, booking and contact forms, music, videos, downloads, merchandise, articles, and related services (collectively, the “Site”). The Site is operated by (“Sea B Music,” “we,” “us,” or “our”).
By using the Site, creating an account, submitting a form, or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.
You must be legally capable of entering into a binding agreement in your jurisdiction. If you use the Site for a company, venue, promoter, organization, or other person, you represent that you have authority to act for that party and bind it to these Terms.
We try to keep descriptions, prices, images, availability, tour information, credits, and other content accurate. Errors, omissions, delays, or changes may occur. We may correct information, update content, limit quantities, or cancel an order affected by a material error, subject to applicable law. Images and audio previews are illustrative and may differ from the delivered physical product or complete recording.
You may be able to create a customer account. You are responsible for providing accurate information, keeping credentials confidential, and all activity under your account. Notify us promptly of suspected unauthorized use. We may suspend or close accounts that violate these Terms, create security risk, or are used unlawfully. Account closure does not remove obligations connected to completed orders or other legal records.
Unless otherwise stated, the Site and its content, including the Sea B and Sea B Music names, music, sound recordings, compositions, lyrics, performances, videos, photographs, artwork, logos, graphics, text, downloads, page design, and software, are owned by or licensed to Sea B Music and are protected by copyright, trademark, and other laws.
You may access the Site for personal, noncommercial use. You may not copy, reproduce, distribute, publicly perform, publicly display, modify, create derivative works from, scrape, republish, sell, license, or exploit Site content without prior written permission from the applicable rights owner, except where law expressly permits.
When you purchase a music download, you receive a limited, nonexclusive, nontransferable, revocable license to download and use the file for personal, noncommercial listening. The purchase does not transfer copyright or ownership of the composition, recording, artwork, or other content.
You may not share the file with others, upload it to file-sharing or social platforms, resell it, distribute copies, use it in advertising or other commercial content, synchronize it with video, publicly perform it, remix it, sample it, or create derivative works without all required written permissions and licenses.
Download availability, file format, compatible software, and any download limits will be described on the applicable product page or order confirmation. You are responsible for using a compatible device and maintaining your own backup after downloading.
Merchandise descriptions should identify available sizes, colors, materials, and other important characteristics. Product colors and appearance may vary by screen and production batch. Select options carefully and review the order before checkout. Availability is not guaranteed until we accept the order.
Your order is an offer to purchase. An automated acknowledgment does not necessarily mean we have accepted the order. We may refuse or cancel an order for reasons such as product unavailability, pricing or description error, suspected fraud, payment failure, quantity limits, delivery restrictions, or violation of these Terms. If we cancel after payment, we will issue any refund required by applicable law to the original payment method.
Prices are shown in the currency stated at checkout and may change without notice. Shipping, duties, taxes, and other charges may be added as disclosed before purchase. You authorize PayPal/STRIPE and Sea B Music to charge the selected payment method for the order total. You represent that you are authorized to use the payment method and that billing information is accurate.
Physical orders are shipped to the address supplied at checkout. You are responsible for entering a complete and accurate address. Delivery estimates are not guarantees and may be affected by carriers, customs, weather, events, or circumstances outside our reasonable control. International customers are responsible for import duties, taxes, and customs requirements unless checkout states otherwise.

Returns, exchanges, cancellations, and refunds are governed by RETURNS AND REFUNDS POLICY and applicable consumer law.
Unless applicable law requires otherwise, a digital product generally cannot be returned after the download or access has been delivered. If a file is defective, unavailable, or materially different from its description, contact booking@seabmusic.com with the order number so we can investigate and provide an appropriate remedy.
Submitting the Booking or Contact form is an inquiry only. It does not reserve a date, create an agency relationship, or form a performance agreement. A booking becomes binding only after the parties sign a separate written agreement and any required deposit or payment is received. Performance terms, fees, travel, production requirements, cancellation, recording, publicity, and other event conditions will be governed by that separate agreement.
If the Site permits reviews, comments, testimonials, photographs, or other submissions, you retain ownership of your content but grant Sea B Music a worldwide, nonexclusive, royalty-free license to host, reproduce, display, format, and use it as reasonably necessary to operate and promote the Site and the relevant product or service. You represent that you have the rights needed to submit the content and that it is accurate and lawful.
We may moderate or remove content that is unlawful, infringing, abusive, deceptive, obscene, discriminatory, threatening, private, promotional spam, unrelated to the page, or otherwise inconsistent with these Terms. We are not obligated to publish or retain any submission.

The Site may link to or embed services operated by third parties, including music, video, social media, press, payment, shipping, and retail platforms. We do not control third-party services and are not responsible for their content, availability, security, terms, or privacy practices. Your use of a third-party service is governed by that provider’s terms.

We may modify, suspend, or discontinue part of the Site, a product, a feature, or content at any time. We do not guarantee uninterrupted, error-free, or permanently available access. This section does not limit rights that cannot be waived under applicable consumer law.
To the fullest extent permitted by law, the Site and its content are provided on an “as is” and “as available” basis. Sea B Music disclaims warranties that may legally be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant that the Site will always be secure, uninterrupted, accurate, or free from harmful components. Nothing in these Terms excludes any warranty or consumer right that applicable law does not permit us to exclude.
To the fullest extent permitted by law, Sea B Music and its owners, artists, affiliates, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity arising from the Site or these Terms. Where liability cannot be excluded, our total liability will not exceed the greater of the amount you paid to Sea B Music for the product or service giving rise to the claim during the twelve months before the claim or USD $100. These limitations do not apply where prohibited by law or to liability that cannot legally be limited.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Sea B Music and its owners, artists, affiliates, personnel, and service providers from third-party claims, damages, liabilities, losses, and reasonable costs arising from your unlawful use of the Site, your violation of these Terms, or content you submit. This obligation does not apply to the extent a claim results from Sea B Music’s own unlawful conduct.
We may suspend or terminate access when reasonably necessary to protect the Site, users, rights holders, payment systems, or legal interests, or when these Terms are materially violated. Provisions that, by their nature, should continue after termination will survive, including intellectual property, payment, disclaimer, liability, indemnity, and dispute provisions.
These Terms are governed by the laws of FL, USA without regard to conflict-of-law principles, except where mandatory consumer law requires otherwise. The parties agree that disputes will be brought in the courts located in FL, USA , unless applicable law gives the consumer the right to bring a claim elsewhere.
Before filing a claim, you and Sea B Music agree to make a good-faith effort to resolve the issue by written notice and reasonable discussion, except where urgent injunctive relief or a legally protected filing deadline makes informal resolution impractical.
We may update these Terms when the Site, products, services, or legal requirements change. Updated Terms will be posted with a revised effective date. Changes apply prospectively unless applicable law allows otherwise. Continued use after the effective date constitutes acceptance where permitted by law.
If a provision of these Terms is held unenforceable, it will be enforced to the maximum lawful extent, and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a reorganization, sale, or transfer of the business or Site. These Terms, the Privacy Policy, applicable store policies, and any separate written booking agreement form the relevant agreement between you and Sea B Music.
